Role of Treks ‘n Rapids Pvt. Ltd. as a service provider

Treks ‘n Rapids Pvt. Ltd. (henceforth known as “Company”), is a provider of various kind of services related directly or indirectly with travel and tourism. This may include, but not be limited to, adventure sport activities, holiday packages, booking services for boarding/lodging/travel arrangements, corporate training programmes, camping and adventure events for schools and children, etc. Many of these services and facilities may be created, planned, conducted or organised by the Company. At the same time the company also works as a curator and aggregator of third party services including, but not being limited to, boarding lodging facilities at resorts, campsites and hotels, adventure sport activities, recreational facilities, food and beverage services, travel services, and travel or holiday packages. While the Company is committed to provide the highest grade of services to its customers, it does not assume any responsibility nor guarantee complete satisfaction owing to the nature of majority of the services that may be provided at remote and logistically challenging locations.

Payment Terms

Complete payment for all the trips, tours, packages and services of the Company should be made in advance, at the time of facility booking or 30 days in advance (whichever earlier), unless otherwise specified.

Change in a Programme, Delay or Cancellation by the Company

The Company reserves the right to make alternation is a programme itinerary or cancel any expedition, fixed departure trip or event, including but not being limited to the reason of too few participants for a particular tour. In such cases the participant shall be given a full refund of the charges paid by them in advance. However, the participant/client shall not be entitled to make any further claim for any loss, expenses or damage (either direct or indirect) or for any loss of time or inconvenience which may result from such an alteration or cancellation, including but not being limited to travel tickets, airport or airline taxes, visa, passport, travel gear purchases, medical expenses etc.

Cancellation by the Client

In the event that it becomes necessary for you to cancel the booking due to any reason, we must be notified immediately of the same through written communication. Once we have received your notice the cancellation shall take effect. Payment for such a trip shall not be adjusted towards any future trip(s) or any other product or service. Please note that the following charges shall be applicable on cancellation:

  • If cancellation takes place more than 45 days prior date of trip, your full deposit shall be refunded (after deducting a processing fee)
  • If cancellation takes place 30 – 45 days prior to date of trip, 25% of the total trip cost shall be forfeited
  • If cancellation takes place 15 – 30 days prior to date of trip, 50% of the total trip cost shall be forfeited
  • If cancellation takes places less than 15 days prior to date of trip, 100% of the total trip cost shall be forfeited

Some programmes attract a minimum processing charge. Please check.
No partial refunds or credit will be given for services not availed.

Insurance

Personal travel insurance is not included in the tour price. We strongly recommend you obtain a travel insurance at the time of booking.

Health and Fitness Requirements

While the company does not lay out specific restrictions based on physical fitness nor discriminate on the basis of physical abilities or disabilities, participants must be in good health and reasonable physical condition. Some trips may be physically more remanding and may also require higher level of fitness. It is advisable to consult your physician before opting for any active holiday or experience. It is also very important that the participants share their medical problems clearly before booking a trip. If you suffer from acute heart, chest or muscular disorders, or if you are severely asthmatic or diabetic, or have high blood pressure, you are advised strongly against participating in adventure sports and extreme activities based trips and expeditions. Active holidays generally take place in remote locations with limited to no access to medical facilities for serious problems. Where necessary, evacuation expenses can be difficult, prolonged and expensive. Any expense arising out of medical and evacuation process will be the responsibility of the participant.

Responsibility and Liability

Any client or participant to any holiday, tour, package, trip or service of the Company shall be assumed to have read, completely understood and agreed to the details mentioned herein.

I acknowledge and confirm the following:

I waive any and all claims I may now and in the future have against, and release from all liability and agree not to sue Treks ‘n Rapids Pvt. Ltd. and its owners, directors, employees, guides, agents, associates or representatives (collectively its staff) or the licensor for any personal injury, death, property damage, or loss sustained by me as a result of my participation in an adventure trip or tour with them, due to any cause whatsoever, including without any limitation, negligence on the part of Treks ‘n Rapids Pvt. Ltd., its staff and licensor. I am aware that your adventure trip or tour, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include: physical exertion for which I may not be prepared; weather extremes subject to sudden and unexpected change; remoteness from normal medical services; evacuation difficulties if I am disabled.

I accept all the inherent risks of the proposed adventure trip and the possibility of personal injury, death or property damage or loss resulting therefrom. I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and the activity beyond the accepted safety of life at home or work, and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation.

I agree that if I suffer injury or illness Treks ‘n Rapids Pvt. Ltd., can, at my cost, arrange medical treatment and emergency evacuation service, as they deem essential for my safety. In entering into this Agreement, I am not relying on any oral, written nor visual representations or statements by Treks ‘n Rapids Pvt. Ltd. or its staff or any other inducement or coercion to go on an adventure trip or tour, hence, only of my own free will. I confirm that I have read and understood the terms and conditions of contract and this Agreement prior to signing it or booking a trip with you and agree that this Agreement will be binding upon my heirs, next of kin, executors, administrators and successors.

Jurisdiction

Matters if any subject to the jurisdiction of District Court of Tehri Garhwal (Uttarakhand) only.

Privacy Policy

Treks ‘n Rapids Pvt. Ltd. is committed to ensure that your privacy is protected. Any information shared with us, stays with us. We do not sell, rent, barter or otherwise distribute your personal information as shared with us through this website to any third party.

Information we collect from you

We may collect information from you including your name, job title, address, postal code, phone number and email address, preferences and information relevant for customer surveys and offers.

Information we do not collected

Any Credit or Debit Card information you provide is processed by our payment gateway providers. We do not collect any sensitive information.

Information Sharing

We do not rent, sell, barter, or give away your information to any third party. However, to some extent, information has to be passed on to the courier companies, credit card processing companies, vendors, etc. to enable them to perform their functions related to your order fulfilment. Apart from this normal business requirement, information may also be needed to be shared with law authorities, for fraud detection, and for the safety of our site, employees, management, users, customers and other affiliates associated with us.

In order to understand your requirements and provide you with a better service experience and for the following reasons:
